Criminal Defamation Law
Louisiana law defines defamation as any communication, written or spoken, intended to damage a person's or
business's reputation or livelihood. Defamation is classified as a crime, punishable by a fine up to $500,
imprisonment for up to six months, or both.
Breach of Contract
A breach of contract occurs when one party fails to fulfill its obligations under the terms of an agreement. Common
breaches include failure to perform in good faith, failure to complete the job on time, not adhering to the
contract’s terms, or failing to fulfill the contract entirely.
Tortious Interference with a Contract or Agreement
To prove tortious interference, the plaintiff must establish four key elements:
- A valid contract existed.
- The defendant intentionally and knowingly interfered with the contract.
- The interference caused injury to the plaintiff.
- The plaintiff suffered actual damage or loss as a result.
Loss of Earnings
If your injury results in lost earnings, you are entitled to recover wages, commissions, bonuses, and all other
forms of income and fringe benefits lost due to the injury.
Wrongful Death
In wrongful death cases, damages are available for the surviving spouse, parent, or child of the deceased, and in

Louisiana as a Per Se Defamation State
In Louisiana, plaintiffs can file defamation per se claims without having to prove actual damages. Defamation per
se includes false statements that accuse someone of criminal behavior or contain other harmful accusations, such as
libel or slander. These statements are considered inherently damaging, and no proof of harm is required for the
lawsuit.
Medical and Hospital Expenses
You are entitled to recover reasonable and necessary medical expenses related to your injury, including past and
future costs. These expenses may include hospital stays, surgeries, therapy, diagnostic testing, pain management,
and rehabilitation. Even if your health insurance covers part of the costs, you can still seek compensation for the
full value of medical bills, although your insurer may have a right to be reimbursed.

earning capacity over the course of your remaining working years. These damages can often be greater than other

Damage to Personal Property
If your personal property, such as a vehicle, is damaged, you are entitled to reimbursement for repairs or the
total loss of the property. If the vehicle is deemed a "total loss," you are entitled to recover its full
pre-damage value. Additionally, you may be compensated for substitute transportation expenses while your vehicle is
being repaired.
